Welcome to MÉNU by Interatek. These Terms and Conditions govern your access to and use of our digital menu management platform. By registering an account or using our services, you agree to be bound by these terms.
1. Description of the Service
MÉNU by Interatek is a Software as a Service (SaaS) platform designed for restaurants, cafés, and food service businesses. The platform enables you to create, manage, and publish digital menus accessible via QR codes and direct links. Features include multi-branch management, product catalogs, menu customization, and analytics.
2. Account Registration
To use MÉNU, you must create an account by providing accurate and complete information, including your name, email address, and company details. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.
3. Subscription Plans and Billing
MÉNU offers various subscription plans with different feature levels. Plan details, including pricing, menu limits, branch limits, and analytics access, are displayed on our pricing page and may change with prior notice.
Payments are processed securely through Stripe. By subscribing, you authorize recurring charges according to your chosen billing interval (monthly or annual). All prices are displayed in US dollars unless otherwise indicated.
You may upgrade or downgrade your plan at any time. Changes take effect immediately, with prorated charges or credits applied to your next billing cycle. Refunds are not issued for partial billing periods.
If a payment fails, your account will enter a grace period of 5 calendar days. If payment is not resolved within this period, your account will be suspended and access to your menus will be restricted.
4. Free Trials
Certain plans may include a free trial period. During the trial, you will have full access to the plan's features. If you do not add a payment method or cancel before the trial ends, your account may be downgraded or suspended. Trial availability and duration are determined at our discretion.
5. User Content and Intellectual Property
You retain ownership of all content you upload to the platform, including product images, descriptions, logos, and menu designs. By uploading content, you grant MÉNU by Interatek a limited, non-exclusive license to store, display, and distribute your content solely for the purpose of providing the service.
The MÉNU platform, including its software, design, logos, and documentation, is the intellectual property of Interatek. You may not copy, modify, distribute, or reverse-engineer any part of the platform without our written consent.
6. Acceptable Use
You agree not to use the platform to: upload illegal, defamatory, or infringing content; attempt to gain unauthorized access to other accounts or systems; use automated tools to scrape or collect data from the platform; distribute malware or engage in any activity that disrupts the service; resell or sublicense access to the platform without authorization.
7. Service Availability and Limitations
We strive to maintain the platform's availability but do not guarantee uninterrupted or error-free service. Scheduled maintenance will be communicated in advance when possible.
MÉNU by Interatek is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Our total liability for any claim arising from the use of the service shall not exceed the amount paid by you in the 12 months preceding the claim.
8. Termination
You may cancel your subscription at any time through the platform or by contacting support. Upon cancellation, your account will remain active until the end of the current billing period.
We reserve the right to suspend or terminate your account if you violate these terms, fail to pay outstanding charges, or engage in activity that harms the platform or other users. In case of termination for cause, no refund will be issued.
9. Modifications to the Terms
We may update these Terms and Conditions from time to time. Material changes will be communicated via email or through a notice on the platform. Your continued use of the service after changes take effect constitutes acceptance of the revised terms.
10. Governing Law and Jurisdiction
These terms are governed by the laws of the State of Wyoming, United States of America. Any disputes arising from or related to these terms or the use of the service shall be resolved in the state or federal courts located in the State of Wyoming.
